Tom Corbett said Wednesday as he filed a federal antitrust lawsuit against the college athletics governing body.
Corbett said the university and the state have been harmed by what he called "harsh penalties" over the abuse committed by Sandusky, a former assistant football coach. The NCAA "piled on" and acted unlawfully because it stands to benefit from the sanctions, he said.
The 43-page complaint accuses the NCAA of exploiting the Sandusky case, saying its real motives are to "gain leverage in the court of public opinion, boost the reputation and power of the NCAA's president, enhance the competitive position of certain NCAA members, and weaken a fellow competitor."
The NCAA released a statement expressing disappointment with Corbett's action, calling the lawsuit meritless and an "affront" to Sandusky's victims.
At a news conference in a State College hotel, Corbett accused NCAA officials of inserting themselves into an issue over which they had no authority under their bylaws "and one that was clearly being handled by the justice system."
Corbett is asking for a permanent injunction to prevent the NCAA from imposing the sanctions, to which the university agreed in July, as well as costs and legal fees.
The Penn State Board of Trustees issued a statement noting the school was not a party to the lawsuit and played no role in preparing it.
Corbett said he waited until now to file the lawsuit because he wanted to thoroughly research the legal issues and did not want it to interfere with football season.
The university has agreed to pay a $60 million fine for child abuse prevention grants and to endure a four-year bowl game ban for the university's football program, a loss of footballs scholarships and other penalties.
When the deal was announced, Corbett ? who is a member of the university's board of trustees ? said he wanted assurance tax money would not go toward the fine, and added that part of the "corrective process is to accept the serious penalties."
When the sanctions were announced, Corbett expressed relief that Penn State had escaped the "death penalty" that would have dismantled the football program for a season or more.
The NCAA agreement has been unpopular with a significant portion of the university community, but Corbett, who is up for re-election next year, deflected a question about whether his response has helped or hurt him politically.
"We're not going to get into the politics of this," he said. An outside law firm was being retained to handle the matter, but Corbett's general counsel did not provide an estimate of cost.
"Any of the costs associated with this ... pale in comparison" with the losses people have already suffered, said Corbett's top legal adviser, James Schultz.
Corbett, a Republican, said his office did not coordinate its legal strategy with state Attorney General-elect Kathleen Kane, who is scheduled to be sworn in Jan. 15. Instead, the current attorney general, Linda Kelly, agreed to grant the governor authority to pursue the matter.
Kane, a Democrat, ran on a vow to investigate why it took state prosecutors nearly three years to charge Sandusky, an assistant under longtime football coach Joe Paterno. Corbett was the attorney general when that office took over the case in early 2009 and until he became governor in January 2011. Schultz said he would talk with Kane about the lawsuit later Wednesday.
The late football coach's family released a statement Wednesday saying they were encouraged by the lawsuit. Corbett "now realizes, as do many others, that there was an inexcusable rush to judgment" in the aftermath of the Sandusky scandal, the statement said.
State and congressional lawmakers from Pennsylvania have objected to using the NCAA's fine to finance activities in other states. Penn State has already made the first $12 million payment, and an NCAA task force is deciding how it should be spent.

BEIJING (Reuters) - China's official manufacturing purchasing managers' index held steady in December at 50.6, matching November's seven-month high, as growth in new orders was unchanged and the pace of output softened marginally.
With the main index above 50 for three straight months, the survey indicates that China's vast factory sector is expanding. The official PMI was released a day after a similar survey by HSBC suggested manufacturing activity at its strongest since May 2011.
Together the surveys support a growing consensus that economic activity in China revved up during October to December, after GDP growth had slowed for seven consecutive quarters to 7.4 percent in the third quarter. That provides a welcome sign for a global economy where both the euro area and Japan are in recession and the United States is struggling for significant growth.
"Output has stayed above the 50-mark, showing that the manufacturing industry appears to maintain growth expectations, but the rate of growth has weakened," the National Bureau of Statistics, which released the data, said in a note.
The official PMI reading was slightly below expectations in a poll of economists by Reuters last week that predicted a rise in the PMI to 51.0.
The survey showed output in oil processing, quarrying and tobacco industries slipped while food processing, auto manufacturing, textiles, steel and electronics all expanded, the bureau said.
A new export orders sub-index fell to 50 from 50.2 in November. A PMI reading below 50 suggests growth slowed, while a number above 50 indicates accelerating growth.
HSBC said its China PMI, which gathers more data from smaller, privately held firms with a strong export focus, rose in December to 51.5, its highest since May 2011.
The HSBC survey showed strong output despite a retreat in a sub-index tracking new export orders. China's export sector, a major source of growth for the economy, must combat slowing demand in its biggest markets and rising wages and costs at home.
China's official PMI generally paints a rosier picture of the factory sector than the HSBC PMI because it focuses on big, state-owned firms. The HSBC PMI targets smaller, private firms. There are also differing approaches to seasonal adjustment between the two surveys.

Some analysts caution that the pickup in economic activity in recent months may reflect renewed investment spending, rather than the consumer activity that policymakers acknowledge is needed to rebalance the economy.
"It's pretty clear that it's more driven by infrastructure and increasingly housing, that's driving heavy industry," said Zhang Zhiwei of Nomura International, speaking on Monday.
Rising land prices have prompted widespread expectations that the real estate market will be revived by an investment-driven recovery that would offset weak export markets, even though the central government had pledged to maintain investment and purchasing restrictions to try to control prices.

For the review and meta-analysis, the researchers identified 97 studies that met inclusion criteria, which provided a combined sample size of more than 2.88 million individuals and more than 270,000 deaths. Regions of origin of participants included the United States or Canada (n = 41 studies), Europe (n = 37), Australia (n = 7), China or Taiwan (n = 4), Japan (n = 2), Brazil (n = 2), Israel (n = 2), India (n = l), and Mexico (n = l).
All-cause mortality HRs for overweight (BMI of 25-
The researchers found that the summary HRs indicated a 6 percent lower risk of death for overweight; a 18 percent higher risk of death for obesity (all grades); a 5 percent lower risk of death for grade 1 obesity; and a 29 percent increased risk of death for grades 2 and 3 obesity.
The authors note that the finding that grade 1 obesity was not associated with higher mortality suggests that that the excess mortality in obesity may predominantly be due to elevated mortality at higher BMI levels.
The researchers add that their findings are consistent with observations of lower mortality among overweight and moderately obese patients. "Possible explanations have included earlier presentation of heavier patients, greater likelihood of receiving optimal medical treatment, cardioprotective metabolic effects of increased body fat, and benefits of higher metabolic reserves."
The use of predefined standard BMI groupings can facilitate between-study comparisons, the authors conclude.
